The Maternity Benefit Amendment Act (2017)

The Maternity Benefit Amendment Act of 2017 states that every establishment having fifty or more employees shall have a childcare facility within a one kilometer radius, either onsite or via a tie-up with a child care operator nearby. This recognition by the Government has reiterated the demand for a more inclusive workplace, catering to the needs of all employees.

In 2020, the benefits under the Maternity Benefit Act were moved under The Code Of Social Security 2020 under the Ministry of Labour & Employment. The purpose of this was to amend and consolidate the laws relating to social security for employees, including:

  • Enhanced coverage
  • Extended benefits to workers in organized / unorganized sectors
  • Introducing maximum benefits under minimum governance
  • Reflecting uniformity across the four labour codes – wage, industrial relations, occupational safety, health & working conditions
  • Enforcing more stringently the need of child care support for women employees
